Rental conditions

Indicative translation. This agreement is drawn up in French and only the French version is legally binding. This English translation is for information only.

Booking and payment

This agreement is made between SARL Gîtes Mosaïques, hereinafter "the owner", and the tenant.

• The agreement is deemed accepted as soon as the owner receives the deposit.
• The rental is guaranteed by receipt of the deposit, generally set at 30% of the rental amount.
• The balance is payable before arrival or when the keys are handed over.
• For groups, the balance is payable one month before the start of the stay.
• If the tenant cancels, the deposit paid will not be refunded.
• In the event of cancellation less than one month before the start of the stay, the full rental amount remains due and payable.

Liability and rental rules

• The furniture, facilities and swimming pool are the responsibility of the tenants, who must return them in the same condition as on arrival.
• Missing, damaged or broken items will be reimbursed at cost price. Replacement is not permitted.
• The tenant must report any damage or breakage immediately.
• The swimming pool is for the exclusive use of the tenants, at their own risk.
• Pool users must take a shower before swimming.
• Children must be supervised at all times when they are in or around the pool.
• Pets are not allowed, unless the owner has given prior and explicit permission.
• Initial cleaning is included in the rental price.
• Tenants must leave the cottages in a reasonably clean state. Additional charges may be made if they are left excessively dirty.
• Tenants may play music in the cottages for personal use only, and it must never be likely to disturb neighbours or other tenants.
• Tenants must notify the management of any visit by outside persons.
• The owner accepts no liability for loss of enjoyment for reasons beyond their control, such as water or power cuts, nor in the event of theft or damage to the tenants' personal belongings.
• Any breakdown or technical failure must be reported to the owner as soon as possible.

Security deposit

• The owner reserves the right to ask tenants for a security deposit on arrival, to cover any damage caused by the tenant.
• It will be returned to the tenant on departure, less any damage.
• If the amount of the damage exceeds the deposit, the difference will be due and payable.
• The deposit may also be withheld if the rental rules are not respected, such as noise nuisance or exceeding the capacity of the rented property.

General provisions

This agreement is drawn up in French, in electronic form or on paper; each copy is valid and enforceable against the parties, in accordance with the legal provisions in force. Only the French version of the agreement is authentic; any translation is for information only. The parties agree that any dispute arising from the interpretation or application of this agreement will be settled by the court of Pointe-à-Pitre, Guadeloupe, which is expressly designated as having jurisdiction.
